Terms and Conditions of Finder GPS Tracker by Findertech Australia Pty Ltd

Welcome to Finder GPS Tracker! These Terms and Conditions (“Terms”) govern your use of the Finder GPS Tracker website (https://findertechau.com.au), hardware, and related services provided by Findertech Australia Pty Ltd (“Finder Tech”, “we”, “our”, or “us”).
1. STRUCTURE OF THESE TERMS
To address the different ways our customers use our technology, these Terms are modular:
- PART A: General Terms (Applies to everyone)
- PART B: Hardware & Platform (Applies to all purchases/subscriptions)
- PART C: Managed Connectivity (Applies ONLY if we provide the SIM card)
PART A: GENERAL TERMS
1. Acceptance of Terms
1.1. By purchasing or using Finder Tech products, you confirm you are 18+ years old and have the legal authority to bind yourself or your business entity.
1.2. Acceptance occurs upon purchase or account registration and continues until terminated.
2. Pricing, GST, and Payments
2.1. Pricing: All prices displayed on our website are in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) unless otherwise stated.
2.2. Additions at Checkout: GST and applicable shipment/delivery charges will be calculated and added to the total price at the time of checkout.
2.3. Payments: Subscriptions renew automatically. A 7-day grace period applies post-expiry before full service suspension.2.4. Payment Security: All payments are processed securely via Stripe. Finder Tech does not store, nor do we have access to, your full credit card details or other sensitive financial credentials. Your financial data is handled directly by Stripe in accordance with their security standards.
3. Data Residency and Global Support
3.1. Data Storage: Your tracking and account data is primarily stored on secure cloud infrastructure located in Singapore.
3.2. Cross-Border Access: To provide 24/7 technical support, platform maintenance, and software development, your data may be accessed by our authorized technical and support teams located in Bangladesh, India, and the Philippines.
3.3. Compliance: We take all reasonable steps to ensure that our overseas teams handle your data in accordance with the Australian Privacy Principles (APPs) and our internal data protection protocols.
4. Governing Law & Disputes
4.1. These Terms are governed by the laws of New South Wales, Australia.
4.2. Dispute Resolution: For hardware/software disputes, parties agree to mediation. For telecommunications/connectivity disputes (Managed Solutions only), customers have the right to contact the Telecommunications Industry Ombudsman (TIO) at www.tio.com.au.
PART B: HARDWARE & PLATFORM (Format 1 & 2)
5. Hardware & Warranty
5.1. RCM Compliance: All hardware supplied by Finder Tech is compliant with Australian Regulatory Compliance Mark (RCM) standards.
5.2. Warranty: A 12-month standard warranty applies. Under Australian Consumer Law (ACL), you are entitled to a replacement or refund for a major failure.
5.3. Title & Risk: Title passes upon full payment; risk passes upon delivery.
6. Bring Your Own (BYO) SIM Obligations
6.1. If you choose a “Platform Only” plan, you are solely responsible for the SIM card.
6.2. Compatibility: You must ensure your SIM supports Australian 4G/5G bands (B1, B3, B5, B7, B28).
6.3. Connectivity Liability: Finder Tech is not liable for data overages, network outages, or hardware malfunctions caused by incompatible third-party SIM cards.
7. Surveillance & Legal Compliance
7.1. Consent: You must not track individuals without explicit, informed consent.
7.2. Workplace Laws: Business owners are responsible for complying with the Workplace Surveillance Act 2005 (NSW) and equivalent state laws, including providing the mandatory 14-day written notice to employees where applicable.
PART C: MANAGED CONNECTIVITY (Format 3 – With SIM)
8. Carriage Service Provider (CSP) Status
8.1. When Finder Tech provides a SIM card, we act as a Carriage Service Provider under the Telecommunications Act 1997.
8.2. SIM Ownership: The SIM remains the property of Finder Tech and is licensed to you for M2M data use only.
9. Financial Hardship
9.1. We recognize that customers may experience financial difficulties. In compliance with the Telecommunications (Financial Hardship) Industry Standard 2024, we maintain a formal Financial Hardship Policy.
9.2. To protect the viability of our service, assistance is reserved for genuine hardship. We require formal evidence for any arrangement exceeding 14 days, which may include a Statutory Declaration or accountant’s letter. Finder Tech reserves the right to limit hardship arrangements (typically to a maximum of 90 days) and may restrict services to limited features during the assistance period.
